USE OF THE SOFTWARE PROVIDED WITH THIS EULA (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. READ IT CAREFULLY BEFORE COMPLETING THE PURCHASE PROCESS AND USING THE SOFTWARE. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT PURCHASE AND/OR USE THIS SOFTWARE. BY PURCHASING, COPYING, OR OTHERWISE USING THE SOFTWARE PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA.
- COPYRIGHT. The SOFTWARE is the intellectual property of the Office of Ideal Building for Energy and is protected by law. You acknowledge that all intellectual property rights in the SOFTWARE anywhere in the world belong to the Office of Ideal Building for Energy. Rights in the SOFTWARE are licensed (not sold) to you. The SOFTWARE license gives you the right to use the SOFTWARE in accordance with the terms of this License. The license does not allow you to resell, rent, lease, loan, sublicense or assign the SOFTWARE or any copy thereof, including any related documentation.
- WARRANTY DISCLAIMER. THIS SOFTWARE IS INTENDED TO CALCULATE THE THERMAL RESISTANCE OF ENCLOSED AIRSPACES THAT CONTAIN REFLECTIVE INSULATION LAYER. THIS SOFTWARE AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" AND COMES WITHOUT ANY WARRANTY, EITHER EXPRESS OR IMPLIED OTHER THAN THE PERFORMANCE STATED IN THE TECHNICAL MANUAL. THE USE OF THIS SOFTWARE ARE SOLELY AT YOUR OWN RISK.
- LICENSE GRANT. The Software is licensed on per user basis (for the period of one year starting with the date the license is purchased), not per computer, site or company. This license is not transferable to any other system, or to another organization or individual. You are not allowed to remove any proprietary notices or labels from the SOFTWARE.
- REVERSE ENGINEERING. You agree that you will not attempt to reverse compile, modify, translate, or disassemble the Software in whole or in part. 5. LIMITATION OF LIABILITY. IN NO EVENT SHALL the Office of Ideal Building for Energy BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR OF INABILITY TO USE THE SOFTWARE. The Licensed Program Is Not Designed, Intended, or Authorized for use in any type of system or application in which the failure of the system or application could cause or contribute to personal injury or Death.
- GENERAL PROVISION. This is the entire agreement between you and the Office of Ideal Building for Energy, which supersedes any prior agreement or understanding, whether written, or oral, relating to the subject matter of this EULA. If any part of this EULA is found void and unenforceable, it will not affect the validity of the balance of the agreement, which shall remain valid and enforceable according to its terms. This EULA shall automatically terminate upon failure by you to comply with its terms. The Office of Ideal Building for Energy, on its sole discretion, may modify this EULA in writing at any time.
